Austrian Advocacy Reports ChatGPT Over ‘Uncorrectable Errors’

A prominent privacy advocacy group based in Vienna, NOYB (“None of Your Business”), announced its intention to lodge a formal complaint against ChatGPT in Austria. Citing concerns over what they describe as “irreparable errors,” NOYB alleges that the AI-powered tool, developed by OpenAI, consistently generates inaccurate responses that cannot be rectified by its creators.

 

NOYB’s statement underscores the fundamental issue of accountability and transparency in AI technology, asserting that ChatGPT’s inability to ensure accuracy poses significant risks, particularly regarding personal data. The group argues that under EU law, which mandates the accuracy of personal information, such errors are unacceptable.

 

Maartje de Graaf, a data-protection lawyer at NOYB, emphasized the importance of technology aligning with legal standards, highlighting that if a system cannot produce reliable and transparent results, it should not be utilized for generating individual data.

The complaint specifically points out instances where ChatGPT allegedly provided erroneous information about the birth date of NOYB founder Max Schrems. Despite requests for correction or deletion of the data, NOYB claims that OpenAI refused, citing technical limitations.

 

Furthermore, NOYB asserts that OpenAI’s response to requests for accessing personal data falls short of EU legal requirements, raising doubts about the company’s compliance efforts.

 

This move by NOYB reflects a broader trend of scrutiny and legal challenges facing AI technologies. Since its debut in November 2022, ChatGPT has garnered both admiration and criticism for its capabilities. However, concerns over accuracy and data privacy have led to regulatory actions in various countries, including temporary blocks and investigations.

 

As NOYB seeks intervention from Austria’s data protection authority, the debate surrounding AI regulation and accountability continues to evolve, with stakeholders grappling to find effective solutions amidst rapid technological advancements.
